Important new requirements regarding HS codes falling under regulations of F-gas and ODS

 

In connection with the next phase of the implementation of CERTEX (The EU Single Window Environment for Customs – Taxation and Customs Union), Poland has introduced new requirements for NCTS transit declarations.
The requirements concern goods which may (or may not) fall under specific requirements for F-gas/ODS.
Transit declarations which contain HS codes which may be linked to F-gas/ODS are being rejected unless they include Additional Reference document codes.

 

For any HS codes found in this dictionary for ODS – https://puesc.gov.pl/o/seap-lf-rest-internal-pdr/dict/xml/PLL100NCTSP5

One of the following Additional Reference codes is required;

  • Additional Reference code Y792 should be added to declare Substances, products, equipment, other than those falling within the scope of Regulation (EU) 2024/590
  • Additional Reference code Y793 should be added to declare Products and equipment containing ozone-depleting substances or whose functioning relies upon those substances, imported/exported as personal effects (Article 5(2) Regulation (EU) 2024/590)

One of the following Additional Reference codes is required;

  • Additional Reference code Y160 should be added to declare Goods other than those falling under the applicable provisions of Regulation (EU) 2024/573
  • Additional Reference code Y162 should be added to declare Exemption from the presentation of a valid licence to the customs authorities for the import or exports of products and equipment that are personal effects (Article 22(1), second subparagraph of Regulation (UE) 2024/573)

 

  • If neither Y160 nor Y162 are declared then the following codes all need to be declared;
    • Y123 Undertaking registered in the F-Gas Portal according to Article 20 of Regulation (EU) 2024/573
    • Y121 Tonnes of CO₂ equivalent of bulk gases and of gases contained in products or equipment, and parts thereof
    • Y163 Net mass of fluorinated greenhouse gases charged in products and equipment

For any large declarations which receive such rejections, please use the export excel goods items option to edit and upload the excel to add the Additional Reference codes.
